• Orders - All orders resulting from our price list or from a written Amerikooler quotation are subject to acceptance by Amerikooler, Inc. No production will start until the customer has signed a purchase order, credit approval, production release form and a signed drawing has been received.

• Changes - Changes made by purchaser after fabrication has begun shall be submitted in writing and purchaser agrees to pay any extra cost resulting from changes.

• Claims - Title passes to buyer upon delivery to the carrier unless otherwise indicated. Safe delivery is the responsibility of the carrier and any loss or damage should be noted on the bill of lading before acceptance of shipment(s).

• Codes and Regulations - Amerikooler, Inc. does not assume responsibility or cost for any changes to its products to meet Federal, State or Local codes and/or regulations.

• Restocking Policies - Stock orders which are cancelled or changed by our customer after they have been released for production will be subject to a 25% restocking fee based on the total invoiced amount. Special (Custom-Made) Orders which are cancelled by our customer after they have been released for production will be subject to the total invoice amount.

• Return of Products - No products may be returned without Amerikooler, Inc. written authorization. All freight cost of return products must be pre-paid by the buyer.

• Deposits - All deposits are Non-Refundable after the third day of receipt of order(s), signed drawings and production release forms.
  

• Late Charges Provision - Buyer agrees to pay a late charge of 1% per month (12% per year) or 1.5% per month over 90 days for any invoice not paid within sixty (60) days of the date of the invoice, plus a $50.00 administration fee.

• Taxes - No taxes are included. All prices and/or sales orders shall be subject to increase without notice to out customers, by the amount of any present or future sales or excise tax levied or charges, either by Federal, State, or any other tax assessing agency.

• Contingency - All contracts are contingent upon fire, strike, weather conditions, delays by carriers, delays by suppliers, Act of God or other causes beyond our control. It is expressly understood that Amerikooler, Inc. is not responsible, nor will be held liable for damages and /or injury caused to building, contents, products or persons by reason of installation of any of our products.

• Storage Policy - Orders produced, or in production, in accordance with customer signed production release form, that are placed on hold, will be stored at our facility for up to three (3) days at no charge. Beginning on the fourth (4) day after the scheduled ship date, storage charges of 1% per week of the invoice amount and will be added to the invoice.

• Literature Material - Amerikooler is not responsible for typographical errors or other errors or omissions in our catalog, brochures, web site, etc. Amerikooler, Inc., reserves the right to modify and/or change specifications without notice.

• Warranty - Please refer to our standard published ten (10) year, five (5) and one (1) year limited written warranties.

• Choices of Law, Disputes - This agreement and the performance of the parties hereunder shall be construed in accordance with and governed by the law of the State of Florida and shall be deemed made in the state. Buyer irrevocably consents to the exclusive jurisdiction of the courts of Miami-Dade County, Florida, on all matters arising out of or relating to this sale and Buyer further irrevocably consents to service of process by certified mail, return receipt requested, at Buyer's address set forth in the order acknowledgement.

The above terms and conditions apply to all orders placed with the seller and accepted by Amerikooler, Inc. Buyer acknowledges having read and understood these terms and conditions and agrees to abide by them upon placement of any order with Seller. In the event it becomes necessary to refer the account to a collection agency or to institute legal action to obtain payment of the account, Buyers agrees to pay all reasonable attorney fees and court costs incurred by such action.

Product improvement is a continuing commitment of Amerikooler, Inc. Research and design require that we reserve the right to modify and / or change specification and prices without notice. It is up to AmeriKooler, Inc. to offer a grace period of 30 days.
